Malton supermarket plans quashed in court

A judge has overturned a decision to allow a new supermarket to be built in Malton.

Ryedale District Council had approved plans for the store and petrol station on the town's Wentworth Street Car Park.

High Court judge Mr Justice Dove has now quashed the planning permission.

The decision went to court because the Fitzwilliam Malton Estate hoped to build a supermarket on another site and challenged the plans.

The judgement was delivered in the High Court in London.

Councillor Linda Cowling, leader of the council, said: "Judicial review is different to a planning appeal.

"The judgement is not challenging the appropriateness of the development, but has considered the process of reaching the decision."

Developer GMI Construction has lodged an application to appeal against the decision, the council said.
