  2. House built in wrong place 'deliberately'

    Karen Dunn

    Local Democracy Reporter

Council planners have been accused of showing "unjustifiable bias" towards a man who built a house in the wrong place.

In 2017, Mid Sussex District Council’s planning department gave permission for the house to be built in the back garden of Chippendale, in Gatehouse Lane, Burgess Hill.

Last August, neighbours pointed out that it was being built more than a metre away from where it should have been – but no action was taken.

At a meeting of the planning committee on Thursday members were asked to approve the change – which the developer insisted had been made in error.

Neighbour Claire Pickford was just as insistent that the change had been deliberate.

Mrs Pickford told the meeting she had received "no satisfactory responses" as to why the concerns raised in August had been ignored, or why enforcement officers had not called for building work to be stopped while the matter was dealt with.

She added: “The planning department has shown an unjustifiable bias towards the developer, resulting in the current situation.

“Had this been addressed at an early stage, costs could have been avoided.”

Members were told that planning law gave clear guidance stating that action – such as ordering the home to be demolished and rebuilt in the right place – should not be taken just because there had been a technical breach of the permission.

The application was approved by five votes to four.

Mid Sussex District Council has approved its part of an application to build 25 homes in Burgess Hill.

The council gave the nod to an application from Brookworth Homes Ltd to improve the road leading into the site in Valebridge Road.

The bulk of the site sits inside the Lewes boundary, so it will be up to Lewes District Council to approve the actual houses.

If Lewes approves the application, the homes currently on the land – Pump House and Nuggets – will be demolished.

  8. Cocktail bar’s bid to sell booze without food fails

    Sarah Booker-Lewis

    Local Democracy Reporter

Cocktail specialist Twisted Lemon’s bid to sell alcohol without food has failed.

The popular bar in Middle Street, Brighton, has a restaurant licence and must sell food with its cocktails.

Sussex Police and Brighton and Hove City Council licensing department were made aware it was selling alcohol without food.

In December 2018 the bar failed a third test sale, in which it was found not be be serving “substantial food”.

The owners Mark Friel and Todd Williams requested the terms of the licence to be relaxed, without which the business may have to close, as customers were mostly there for cocktails only.

However the council licensing panel’s refused, saying while it "appreciates the difficult position the applicants find themselves in" having another bar in an "already saturated and challenging area" may impact on crime, disorder and public nuisance.

  16. Petition over Brighton arches restoration

    Sarah Booker-Lewis

    Local Democracy Reporter

More than 3,000 people have signed a petition calling for the restoration of the Madeira Terraces to begin with three arches close to the Concorde 2 nightclub.

The petition that was presented to Brighton and Hove City Council on Thursday

Madeira Terraces campaigner Derek Wright said he was concerned restoration work would start nearer the Palace Pier.

He said the arches there were not typical as they had basements and were nearer existing businesses where current building work was “already having a disastrous effect on trading”.

    Madeira Terraces

Mr Wright said that one advantage of working with the music venue would include bringing the Madeira Lift into use all year round, helping with wheelchair access to the area.

“We really think our idea will increase the footfall significantly to this area of Madeira Terraces and to the existing, nearby and new businesses that we need to attract.”

An online funding campaign to restore the Madeira Terraces has raised almost £500,000.

The petition is due to be considered by the council's development and culture committee on 20 June.
