  10. Stagecoach: No choice but to pursue legal action

    Gavin Bevis

    BBC News

Stagecoach chief executive Martin Griffiths said the company was "deeply concerned" about how the Department for Transport handled procurement of the East Midlands, South Eastern and West Coast rail franchises.

He said: "Despite our continued requests for full transparency around these matters, many fundamental questions remain unanswered.

"As a result, regrettably we have had no option but to commence legal action against the DfT to ensure the serious issues involved and the DfT's opaque decision-making are subject to proper public scrutiny."

He continued: "In view of the legal action we have taken today, we believe it would be untenable for the DfT to proceed to sign any contract for the East Midlands franchise without a full and proper review of the procurement of that franchise to help restore public confidence in the process."

The Department for Transport said at the time of Stagecoach's disqualification the company had "repeatedly ignored established rules" and that other bidders had met its requirements.

Last month, the DfT rejected Stagecoach bids for the East Midlands franchise, the South Eastern franchise with Alstom, and a renewal of the West Coast franchise with Virgin Trains and France's SNCF because they did not meet pensions rules.

Stagecoach said it could have been left with liabilities of £1.6bn if it had agreed to accept pension risks.

"From the start the Duke and Duchess have been doing things slightly differently, so there was no reason for us to think they would do the same as others," he added.

"They are doing things differently, but it’s nice that they are still following some of the family traditions.”
