Brexit challenge lawyer says EU referendum not binding

Parliament could have made the EU referendum legally binding but chose not to, the Supreme Court has been told.

"When Parliament wishes to make a referendum binding, it does so," said Lord Pannick, acting for Gina Miller, who is campaigning for MPs to have vote on triggering Article 50 of the Lisbon Treaty.

He was speaking on day two of the Brexit legal hearing in which the government is arguing it has the right to go ahead without consulting MPs and peers.
