Luis Moreno Ocampo says warning of an attack does not prevent it from being a war crime

Events in Libya are being keenly watched by the chief prosecutor for the International Criminal Court, Luis Moreno Ocampo.

He is investigating Col Gaddafi for possible crimes again humanity.

Last week he warned that if Col Gaddafi's forces attacked civilians in Benghazi, that could constitute a possible war crime.

So after the weekend's assault by government forces on the rebel stronghold, does that mean he is now investigating war crimes as well?
