These ts&cs were last updated in November 2014.
1 Eligibility Criteria Registration
1.1 For you to be registered with the BBC Get Inspired Activity Finder you must be a publicly-funded or not-for-profit organisation. 1.2 It is important that you understand that registering with the BBC Get Inspired Activity Finder and being described on the BBC Get Inspired Activity Finder as a “partner” does not necessarily mean that you have entered into a “Public Value Partnership” with the BBC as described in the BBC's Editorial Guidelines. 1.3 When you register you will join a BBC Get Inspired Activity Finder project and any activity you wish to be included on the BBC Get Inspired Activity Finder must therefore relate to BBC Get Inspired Activity Finder projects (e.g. Football, Lacrosse, Dance etc) - these are activities covered by BBC television and radio programmes, and other specific campaigns and/or BBC-driven projects. Activities 1.4 When you add your activity it must comply with the following criteria: a) it must happen on a specific time and date; b) it must include active participation and/or be designed to engage new audiences in the underlying goal of the project. (This means that activities such as spectator events and performances are not eligible. However, coaching and volunteering are eligible as they are included on the Get Inspired website ); c) it must be free of charge to the public or be run on a cost-recovery basis (but may be sited within a paid-for visitor attraction). “Cost-recovery basis” means charging a price to recover the cost incurred in organising your activity, but which is no greater than the costs actually incurred and which makes no contribution to fundraising and/or profit etc). Cost-recovery overheads related directly to your activity can be included. These can include activity-specific equipment and materials, venue hire, trainers and staffing, promotional materials or insurance. Non-activity specific overheads cannot be included; d) it must be accessible to the general public including those with disabilities if reasonably practicable (and you must advise us whether your activity is accessible to people with disabilities or not); and e) it must comply with any Project Specific Criteria (see section 3 below). 1.5 Without prejudice to the foregoing, the BBC reserves the right not to accept you or your activity if it is not editorially appropriate to do so. In making its assessment, the BBC may take into account previous activities you have undertaken (including but not limited to considering the cumulative effect of individual activities) and any campaigning or other activity that may be considered to affect the BBC's impartiality or bring the BBC into disrepute.
2 Use of Things To Do
2.1 Where the BBC supplies you with branded promotional and educational materials, you will: a) provide such materials free of charge to the public; b) not alter or modify such materials unless otherwise advised by the BBC; and c) not attach such materials directly to any commercial products or activity. 2.2 You must include on the BBC Get Inspired Activity Finder all details related to the cost of attending or participating in your activity (including entry fees). 2.3 You will provide feedback to the BBC on use of the BBC Get Inspired Activity Finder if required. 2.4 You acknowledge that the BBC may contact you regarding project initiatives and changes to the BBC Get Inspired Activity Finder.2.5 When entering your activities into the BBC Get Inspired Activity Finder, the information should contain only content that: a) is clearly relevant to the BBC radio or television programme, or other campaign; b) is suitable for the likely audience, which may be children; c) does not feature the name of any sponsor or organiser in the title; d) does not promote a particular political or religious cause; e) is free from any sponsorship details, product advertising or promotions for commercial activity and free from any promotion of charitable fund-raising activities; and f) is factually accurate, and you are responsible for ensuring that such information is regularly updated and refreshed in order to ensure that it remains factually accurate. 2.6 When entering data into the BBC Get Inspired Activity Finder you may include a link to a page on your own website, however, this page should only contain content that is: a) clearly relevant to the content of the BBC page where the link is placed; b) suitable for the likely audience, which in some cases may be children; c) regularly updated and refreshed; d) free to access; e) free from any suggestion that the BBC endorses you or any other organisation, or any of your views or opinions or of any other organisation; f) free from any suggestion of a BBC endorsement of any commercial product or activity; and g) factually accurate. In any event, the BBC reserves the right not to publish this link if the site does not comply with BBC Editorial Guidelines on linking: http://www.bbc.co.uk/guidelines/editorialguidelines/page/guidance-links-feeds-summary , on the basis, for example, that the site features sponsorship detail, product advertising, promotions for commercial activity or charitable fund-raising activities. 2.7 The BBC reserves the right not to publish information if it is not editorially suitable (including but not limited to not meeting BBC Editorial Guidelines). 2.8 The BBC may from time to time, and in accordance with BBC Editorial Guidelines, allow fund-raising activities to appear on the BBC Get Inspired Activity Finder where these activities relate to any of the cross-BBC charity fundraising initiatives.
3 Project-Specific Criteria
3.1 The BBC may notify you of new promotions which have been published on the BBC Get Inspired Activity Finder, including any additional eligibility criteria and other requirements that are specific to that promotion. In all cases, your activity should have a direct link to the specific promotion and adhere to all criteria. 3.2 Bear in mind these projects and the Project-Specific Criteria may be updated from time to time, so you should check before starting to contribute new types of activities to the BBC Get Inspired Activity Finder. 3.3 The BBC may from time to time decide that an activity already featured under one BBC Get Inspired Activity Finder category or promotion may be more suitable for inclusion under a different BBC Get Inspired Activity Finder category or promotion (for example, in the event that a new Things To Do category or promotion is introduced). In these circumstances, the BBC may change the activity listing to the new the BBC Get Inspired Activity Finder category or promotion, (but will notify you in advance of this happening), or may request that you change the activity listing to the new the BBC Get Inspired Activity Finder category or promotion.
4 Supply of XML Feeds
4.1 You may supply an XML feed to the BBC Get Inspired Activity Finder in respect of your activities, subject to the following conditions: a) you must obtain prior written approval from the BBC; b) you must liaise on an on-going basis with the BBC to ensure that your XML feed continues to satisfy the technical and policy requirements of the BBC Get Inspired Activity Finder site and these Terms and Conditions; c) your XML feed must contain no reference to any commercial activities, sponsorship or fundraising; d) you take responsibility for moderating the content of the XML feed to ensure compliance with these Terms and Conditions at all times; and e) the BBC reserves the right to withdraw its approval for supply of your XML feed.
5 Publicity and Intellectual Property
5.1 You must not do anything that could give the impression that the BBC is endorsing any commercial product or activities or endorsing you or any other organisation, or any of your views or opinions or of any other organisation. 5.2 You must not use your activity to advertise or promote any services provided by you that are not directly linked to the activity. 5.3 You must seek the BBC's approval before any reference of your involvement with the BBC Get Inspired Activity Finder is published on your website, distributed through publicity materials, press releases or other publicity materials. 5.4 You must seek the BBC's approval of any proposed television and radio publicity for your activity at an early stage in the publicity planning process, and before plans for any such activity are finalised. 5.5 All copyright, trade marks, design rights, patents and other intellectual property rights (registered and unregistered) in and on any project-related materials produced by the BBC for use at activities shall remain vested in the BBC and/or its licensors. 5.6 The names, images and logos identifying the BBC or third parties and their products and services are subject to copyright, design rights and trade marks of the BBC and/or third parties. Nothing contained in these terms shall be construed as conferring any licence or right to use any trade mark, design right or copyright of the BBC or any other third party. 5.7 You must seek the BBC's written permission and must sign a trade mark licence to use any BBC logos or trade marks. This includes not only the BBC blocks logo, but words and logos such as “Match of the Day Kickabout” or “Blue Peter”. Requests should be sent to your regular BBC contact or firstname.lastname@example.org with ‘trade mark agreement' in the subject line. 5.8 Copyright in any material owned by you will remain with you and you can continue to use the material in any way including allowing others to use it. 5.9 You hereby grant to the BBC an irrevocable royalty-free licence to publish any images you provide for the BBC Get Inspired Activity Finder in all media in perpetuity for the purposes of promoting your activity, and you warrant that such use by the BBC will not infringe the rights of any third party. This must include use on bbc.co.uk and on third party websites via: a) widgets (e.g. small search boxes, lists or images constructed from HTML that are embedded into websites, and through which the BBC Get Inspired Activity Finder information - including your own - can be accessed); and b) shared data (data feeds that allow the BBC Get Inspired Activity Finder information - including your own - to be incorporated into third party, commercial and non-commercial publicly-funded or not-for-profit websites).
6 Health & Safety and Insurance
6.1 You acknowledge that the BBC is not responsible for your activities. You agree to, and shall procure that your sub-contractors agree to, comply with all applicable disability discrimination legislation; health, safety and fire legislation; data protection legislation, and all codes of practice made under such legislation including but not limited to those issued by the Health & Safety Executive, the Home Office and any BBC safety requirements notified to you. 6.2 You must arrange and maintain with a reputable insurer adequate insurance, including General/Public Liability Insurance, with a limit and scope of cover appropriate to the activity/activities in question.
7 Child Protection
7.1 Before uploading an image on the BBC Get Inspired Activity Finder, you must obtain written consent from the parents/guardians of any children (under the age of 18 years) featured in any images. 7.2 In relation to activities for or with children, you must have in place a child protection policy, the scope of which is no less than that of the BBC's Child Protection Policy bbc.co.uk/aboutthebbc/policies/child_protection.shtml . In particular, but without limitation, you will carry out Disclosure and Barring Service (previously CRB) checks as appropriate.
