Government rejects Nalini's plea

Nalini cannot be released taking into account her past actions, court was told
The Tamil Nadu government has told the Madras High Court that it accepts the recommendation of the Prison Advisory Board (PAB) not to release Nalini, a life convict in the Rajiv Gandhi assassination case.

The PAB has recommended that it is not advisable to release nalini citing eight reasons.

The state Advocate-General (AG), PS Raman, informed the division bench of the Madras High Court the stand of the state government when the case was taken for hearing on Monday.

The PAB has said that Nalini is convicted of serious crimes including sheltering the prime accused.

It has also said that Nalini was aware of the plot to assassinate Rajiv Gandhi.

Attitude 'not changed'

The PAB has further said that Nalini has not changed her attitude and as such has not confessed to the crime and tendered an apology.

While Nalini’s parents have undertaken to shelter her in the event of she being released from prison, the PAB has stated that they too were in prison in connection with this case.

Moreover the place where Nalini’s parents reside has many important offices including the American consulate and as such, she staying with them would cause law and order issues the PAB has stated.

The PAB has also rejected the request by Nalini that she would just like to be the mother of her child.

Also taking into account the past actions and behaviour of Nalini she cannot be released, the AG told the High Court.

The AG also told the division bench that the medical report submitted by the psychiatrist also not conclusively recommended her release.

Based on the observations and recommendations made by the PAB the request for Nalini’s release has been rejected, the AG told the court.

'Not proper panel'

Normally life convicts may be released based on good conduct after completion of 14 years in jail.

Nalini had pleaded before the court that the advisory board constituted to advise the government on her release earlier had not been constituted properly.

A new board under the chairmanship of the Vellore district collector was formed by the government based on Nalini’s petition which has made the present recommendation.

The government decision is based on the new committee’s recommendations.

The court also heard Nalini’s another petition seeking release based the action taken by the Tamil Nadu government when it released 472 life convicts in connection with the birthday of the former chief minister Annadurai.

The state government contended before the division bench that since Nalini's case was investigated by the Central Bureau of Investigation she was not eligible to be released on the grounds like other convicts.

The case has since been adjourned.
