Commissioner not bound by court opinion
 
Advice sought from Supreme Court
Elections Commissioner is not bound by the opinions expressed or advice given by the supreme court,says the human rights lawyer, J.S.Weiliamuna.

He said that the president has sought the advice of the supreme court on the holding of presidential elections.

In recent weeks the opposition (UNP) has been trying to make a political issue of the conduct of the poll.

Given that it is a constitutional issue and the controversy created by the Opposition, the President under Article 129 - 1 of the Constitution has sought the determination of the Supreme Court on the date of the election.

"The supreme court will only advise and interpret of its opinion and it is not going to be a judgement. Therefore, election commissioner will have his own say.", Weliamuna said.

However, he said, this could lead to a constitutional crisis as there is the possibility of going to court against the decision of the election commissioner.
