A firm which was fined pounds £1,000 after under age girls were sold drink in an Aberdeen venue has had its conviction quashed by appeal judges.
The Epic Group Scotland was convicted of selling alcohol at Prohibition in Langstane Place to two teenagers who were just short of 18.
Lady Smith said a justice of the peace failed to direct himself on the correct test of whether the employer had exercised all due diligence.
The girls had dressed to appear older.
Defence counsel Shelagh McCall said a statutory defence was available where a firm did not know the offence was taking place and they had exercised all due diligence to prevent it being committed.
