Kent County Council warned home school register plans 'may be illegal'

Plans for a register of children being home-schooled in Kent have been put on hold after the chairman of a Commons committee warned the county council that the measure may not be legal.

The council said the number of home-educated children in Kent had risen by 70% since 2008.

It wanted to register them and require their parents to attend meetings.

But a letter from Graham Stuart MP has led the authority to revisit the plans, a spokesman said.

In the letter Mr Stuart, the chairman of the Education Select Committee, told the authority the plans could be in breach of government guidelines and might be liable to a legal challenge.

Roger Gough, the council's cabinet member for education, said: "The view was raised by Graham Stuart and by others that this hadn't been got right.

"I thought that it was prudent and sensible that, at the very least, we examined those arguments and took them seriously and looked over whether that was indeed the case."
