New Music Shorts Campaign - Rules and Regulations 2008
1. The BBC New Music Shorts Campaign (“the Campaign”) is organised by the British Broadcasting Corporation (“the BBC”). The Campaign aims to encourage filmmakers to create new films inspired by new music tracks provided by the independent record labels (the “Short Film”). Filmmakers can enter the scheme by applying online and submitting an idea inspired by one of the music tracks (the “Entry”). Selected entrants will then work with a film production company called Warp Films Limited (“Warp Films”) to make their film.
2. By entering the competition entrants grant the BBC the right to publish free of charge part or all of the Entry on radio, television, online and in any other media as it thinks fit. Once commissioned, the BBC shall have the worldwide exclusive right until [01/12/08] and then the non exclusive right in perpetuity to exhibit or to cause to authorise the exhibition of the Short Film or any part of the Short Film for the purposes of the Campaign:
(i) by way of free television (including but not limited to analogue terrestrial, digital terrestrial, digital satellite and digital cable and any other forms of free television distribution whether now known or hereafter developed);
(ii) by streaming on the BBC’s services delivered to users via the TCP/IP protocols or alternative protocol;
(iii) by download on the BBC’s services delivered to users via the TCP/IP protocols or alternative protocol;
(iv) on the BBC’s interactive TV services such as permanent 24/7 services, enhanced TV and any broadband on-demand IPTV services; and
(v) by streaming and download on a third party website for BBC public service distribution purposes provided that the BBC will not charge any fee for such public service distribution; and
(vi) Non commercial promotional dvd rights for giveaways at events, press promotion of scheme.
(vi) for publicity purposes. BBC shall be entitled to use the publicity stills and 30 second clips or 25% of the total running time, whichever is the shorter.
3. Entrants whose Entry is selected to receive a commission, will work with Warp Films who will produce the Short Film. Warp Films will be responsible for managing the budget on behalf of the BBC and delivering the film to the BBC. Entrants will be required to enter into an agreement with Warp Films to facilitate the production of the Short Film.
4. Entrants consent to being filmed, interviewed and recorded by the BBC and its’ media partners where required for the Campaign and for films or recordings made pursuant to this rule being used for all purposes of the Campaign at any time in any media in perpetuity.
5. The BBC reserves the right to refuse any Entry to the Campaign for any reason at its absolute discretion.
6. The closing date for the competition is 7 July 2008.
7. The decisions of the judges are final. Neither correspondence nor discussion concerning any decision shall be entered into.
8. No entries will be returned. It is therefore advisable for each entrant to retain a copy where appropriate.
9. Entrants warrant to the BBC:
(i) the Entry submitted is their own original work.
(ii) the Entry will not infringe the copyright or any other rights of any third party.
(iii)the entrant(s) must be the sole lawful owner of the copyright in the Entry (iv)the entrant (s) possess all necessary rights to grant the BBC the licence described in clause 2 above.
(v)There is no agreement with any other person which shall any way interfere with any rights granted to the BBC hereunder (vi)Entries are not by law defamatory, obscene profane or pornographic nor contain materials which discloses private or personal matters or personal data concerning any person without such person’s written consent material nor contain any message, data or images that would violate the intellectual property rights of others including unauthorised copyright text, music, images or programs, trade secrets or other confidential proprietary information or trade marks used in an infringing fashion.
10. Entrants may submit only one Entry to the Campaign. Entrants must fill in the application form available on this site and comply with all the entry requirements set out in the section on this site headed 'How to Enter'.
11. Entrants permit the BBC to edit or change entries in any way it may in its sole discretion consider necessary for the purposes of use in the Campaign.
12. The description of the awards prizes and selection process in any Campaign literature or other medium is not binding and may be varied by the BBC and the BBC may make additional awards or prizes but it shall not be obliged to make any award or prize if it considers it inappropriate to do so.
13. The BBC reserves the right to seek and issue publicity on behalf of entrants.
14. Acceptance of these rules is a condition of entry and receipt of an Entry by the BBC amounts to acceptance of the rules.
15. The BBC shall not be obliged to make use of any Entry and shall not be liable for any loss of publicity or enhancement of reputation.
16. Entries are made at an entrant’s own expense and the BBC shall not be liable to reimburse any expenses incurred in making an Entry.
17. Unless specifically stated unsuccessful entrants in any stage may not be contacted by the BBC due to the large number of entries anticipated.
18. The BBC reserves the right to cancel or vary the competition at any stage, if deemed necessary in its opinion, or if circumstances arise beyond its control.
19. The competition is open to all residents (over 18 years of age as at the closing date) of the UK, including the Channel Islands, except BBC employees, Warp Film employees, their close relatives and anyone connected with the competition.
