I doubt the offender is long gone: seems a bit extreme for a landlord to pack up and leave the country just because he allowed someone to smoke in his pub.

Indeed... same as according to them, 700,000 would quit when the ban started... they've changed their mind now and saying around 100,000ish have tried.
