The timeshare resales with a catch

'Timeshare' used to be a dirty word, until the industry polished up its act. These days, they're a safe bet with more and more Brits signing up to a guaranteed two weeks in the sun. But while timeshares are easy to buy, they're not so easy to sell.

That's why a company called the European Timeshare Owners Organisation (ETOO) offers to do it for you. Many of you called the company after seeing its television adverts - and later regretted ever getting involved with the company.
Barry Flint and his partner Tina bought timeshare points in 2004 for £6,000. They decided to sell them this year, and contacted ETOO.

The company told him if he paid their fee of nearly £1,000 it would market his property and do its best to find him a buyer. He refused to give the company any money up front, but a few weeks later, the company called him back.

Barry says ETOO told him it had found a corporate client in Spain who was very interested in buying his points and was prepared to pay the £10,000 he was looking for. So Barry agreed to pay ETOO its £980 marketing fee so that the sale could go through.

But there was a catch.

The buyer was in Spain and for the deal to go ahead he had to fly there at his own expense to meet them. Having paid nearly a thousand pounds already, he felt he had no choice and bought flights.

But the person Barry met was not interested in buying a timeshare. The man ETOO had billed as a 'corporate buyer' was, in fact, a salesman for a holiday club called Club Class Concierge.

The timeshare was practically worthless
The salesman told Barry his timeshare was practically worthless in the current market. He offered to take it off his hands for free, but only if Barry paid nearly £4,500 to join Club Class Concierge. The salesman told Barry he might get his money back under a cashback scheme in the next three years, but there were no guarantees.

Barry was left upset and disappointed before he walked out of the meeting. "I couldn't sit there. I was just shaking with rage."

The sales rep was right on one thing. Barry's timeshare was worth much less than the £9,962 ETOO had promised to market it at. In fact, in the current climate, his points are almost worthless.

Legal action
And Barry's not the only one who thinks ETOO's adverts were misleading. In August, the Advertising Standards Authority ruled ETOO's adverts were misleading, making people believe they would get a sale on their timeshare when the figures show the chances are very slim indeed. Only 8 per cent of people signing up to ETOO ever sold their property, in any capacity.

Allen and Jacky Dearing from Lytham in Lancashire also wanted to sell their timeshare. They too saw the ETOO TV adverts and were convinced it was the answer to their problems.

They rang ETOO and were told the company could market their timeshares, which the company valued at over £22,000. But Allen and Jacky would have to pay them a fee. Allen refused to pay ETOO any money up front.

A few weeks later, ETOO phoned. The company said it had found him a corporate buyer and for fee of 895 euros it would set up a meeting with them in Spain. Allen and Jacky were suspicious, and contacted Watchdog. Our researcher went with them to the meeting.

ETOO arranged a pick up from the hotel, with Watchdog on board, posing as one of Allen and Jackie's relatives. After a 20-minute drive, we arrived at the offices of the holiday club, Club Class Concierge. The premises housed not only their offices, but also those of ETOO.

It soon became apparent, that Billy the man we were introduced to was not a corporate buyer with an interest in Allen and Jacky's timeshare. He was a salesman from Club Class Concierge.

"What do you believe is going to happen here? That I'm going to hand you over a cheque for whatever how much they say?" he asked.

"Well, then if ETOO has said that, then it has lied to you. We're a holiday club, that's what we are."

And as our other ETOO customers have found out, instead of buying the timeshare from you, Club Class Concierge is offering to take it off your hands and allow you to get the money back as part of a cash deal in up to three years' time.

That's not the sort of purchase Jacky and Allen had in mind when they paid ETOO the fee. And when they explained how upset they were, Billy and his boss Rod could only agree how wrong ETOO had been to tell Allen and Jacky they would be meeting a corporate buyer.

But for all their anger at ETOO, boss Rod was forced to admit that the two companies Club Class Concierge and ETOO are part of the same outfit.

Realising Club Class had no intention of buying their timeshare from them in a cash purchase, Jacky and Allen decided to leave. Back at their apartment, Jacky rang ETOO to ask for her 895 euro fee back. After all, they didn't get the sale they were promised. But she had no luck.

Allen and Jacky are part of a long list of people furious at the nature of ETOO's deals.

Mike Haley, director of consumer protection at the Office of Fair Trading, says people should watch out for timeshare resale companies like this.

"If you are invited to Spain, if you are asked for any fee up front, then it's likely to be a scam."

He warned consumers to be very wary about paying any fees in advance or travelling anywhere else to conclude the contract. "If they've got a genuine buyer for your timeshare you won't have to pay up front and you can conclude the contract while you're at home, at your leisure."

When Watchdog contacted ETOO it confirmed that ETOO, and Club Class Concierge were subsidiaries of the same corporation.

It said if after a period of time ETOO finds it has not achieved a sale of the client's timeshare to a private individual, it will then contact the clients to ask if they would consider alternative options such as passing the client's details to various marketing companies, including Club Class Concierge.

ETOO insists: "During this invitation call, clients are never told that they will receive a cash offer" and that ETOO "constantly monitors calls to make sure this is adhered to". The company further states that the price a client's timeshare is marketed at is the decision of the client.

It adds: "It is a strategic decision not to mention the name of the company interested in meeting the client." They said this was because clients have previously been told the name of the company they are due to meet (Club Class Concierge) in advance and in some cases have "researched and subsequently made direct contact with the wrong distributor which in turn has created confusion and we have had to diffuse conflict between distributors".

The company further adds: "In cases where it comes to our attention that overenthusiastic telemarketing staff are economical with the truth or even lie, if it is clear cut and justified we make a full refund of marketing fees to unsatisfied clients."

ETOO says the marketing package that comes with the marketing fee includes: "An advert detailing the client's specific ownership in the national press as well as a featured listing on our website www.etoo.com. (We have spent over 1 million euros on media advertising in the last 12 months driving traffic to our website)."

In response to Barry Flint and Tina Jerrom's complaint, ETOO says: "The clients were invited to Spain to ascertain whether they would be interested in an alternative solution to their ownership." And that their "ownership details will remain actively marketed by ourselves on an ongoing basis unless they advise us otherwise."

As for Mr and Mrs Dearing, ETOO told Watchdog that their story is much the same as Barry and Tina's but that they would be, "investigating this matter in great depth by studying our telephone records to see whether these clients are eligible for a refund."

OFT action
The OFT has been looking into consumer complaints about holiday clubs in general and it has launched a scheme at major UK airports to warn travellers. In particular the public should be wary of scratch card scams at holiday destinations. These schemes make you think you've won a prize, when in fact, they're just a chance for holiday clubs to pressure sell you membership of their schemes, which can cost thousands of pounds.

Watch a video with Mike Haley talking about the scheme.

Of course there was no buyer, the only reason we never got invited to Spain was shortly after paying them we realised what they were about and e-mailed them telling them so!!!
We managed to get the money back from our credit card company after 12 months of waiting.

A few weeks later they came back and asked if we would meet a corporate client in Maidenhead

    "Club Concierge" !!!!!

We attend only to be told don'e expect that you will be getting any money from us today and then tried to sell us their club for which we would have to pay about £4000 up front and we would get back the £4000 plus £5500 if we remained members for three years.

I said that we were not prepaired to pay out any more money and we left.

Have contacted our credit card company and they will get our money back after expirey of the one year contract, and after that period we have to advise them that ETOO have failed to fullfil their contract.

I am now trying 'Visa dispute' (section 75) as I paid the fee by credit card but I dont hold out much hope- the Watchdog programme should help though.

We were told of a cash back scheme and after investing more money we would receive it all back at a later date. It was either 3 or 4 years, I would have to dig out all the paperwork again, which has been filed under lost cause.
Our timeshare is a gold holiday week at the Marriott Marbella Beach Resort in Elviria. There has also been a blog about ETOO on the "Eye of Spain" website. I would love to hear about someone who did get cash for their timeshare from ETOO but I am afraid I never will.

Hi, We contacted our Timeshare Company to advise them that we wanted to sell our timeshare. We were advised that they didn't buy back and we should look on the web for a buyer or 3rd party to sell on our behalf. Etoo was the main find, unfortunately we did pay out on our credit card but this was November last year and I don’t think that we will be able to claim it back after this length of time. We had a call within the 2 weeks to advise that we had a buyer for more than we were expecting. We paid for our flights to Spain where we met another couple who also had done the same as us and went off to our meetings. We were taken to the canteen for an informal chat and coffee advising Club Class Concierge that we were selling to free up some money to start a new business, we were separated for the other couple and the chat started. It only took a few mins to realise that what we were told was not what was on offer by Club Class Concierge. They wanted us to give them our timeshare for 2 years and pay them a monthly fee for 24 months. After the 24 months we could cancel our membership and they would then pay out. We advised that this is what we were told was going to happen at that point Ron was then pulled in to our meeting. He advised that ETOO had history in advising the incorrect information regarding the service that Club Class Concierge had to offer and that we should send a letter of complaint to ETOO in Gibraltar. Our meeting only lasted 30 mins we requested a taxi back to our hotel. My husband and I decided that as we had paid for the flights we wanted to try and enjoy the time we had and went for a walk. We were sitting on the front when we noticed the other couple who had been looking for us. They had also been advised that they had a buyer but once the meeting started they realised that it was not what was offered to them and had left before us. We all went for a meal and decided to see what we could do back home. When we got back to the hotel I used the free internet service and sent a complaint to ETOO regarding the issues from our meeting - I had sent several e-mails to CCC and ETOO I had a reply advising that my complaint had been passed to the correct department and a letter followed a few weeks later. This all happened in Feb 2008 and we have heard nothing else since. Please can something be done, and can anyone help us and any other people who have been just like us in looking for assistance in selling a timeshare or passing this back to the timeshare company.........

Yes, I can only commiserate with all the pepole duped by Etoo. I am a fairly suspicious person by nature but even asking all the 'right questions' before I signed the contract, we agreed to go to Spain to get the offer from their corporate client. We were somewhat comforted that we sat next to Chris Quinten (Brian Tilsley off Coronation Street) who was their Hospitality Director, however the salesman featured on the programme said exactly the same sales pitch to us and even scared us by stating that we had better get rid of our Timeshare as our sons and daughter would be sued for the maintenance fees after our death if they didn't carry on paying them and even showed us an e.mail as 'evidence' of this actually happening. We were such good customers that we were offered in to CCC for the the unbelievable sum of 19,950GBP. Needless to say when the 'killer' offer came I shook with rage and asked to be driven back to the hotel. This company needs to be put out of business quickly to avoid any other people being duped and suffering significant loss and wasting their valuable time. It is immoral what CCC and Etoo are doing.

Our over-riding concern was to get rid of something we had to pay for and were not going to use again. Allow for annual fees to rise by at least 10% p.a and you may find it best to pay out 6 years worth now and maybe (probably not) get something back in 3 years - at least you have put a stop to infinite rising cost. A few companies used to allow you to return ownership at no value (which is what it's worth, look on e-Bay) but that's all stopped because they want the annual income.

It was just like your programme, exactly the same words from the salesman, we just left.

(As they claim their website is secure we assumed ETOO had got the information via them). No one was available, (for 3 weeks).I then checked ETOO out on their website and it all seemed ok! The pressure was on, and like other people, the thought of getting rid of this ever increasing costly millstone, we paid out £840 plus air fares etc. Of course, all this took time, approx 12 weeks, too late to cancel! The scenario was exactly the same, and although all this happened almost 2 years ago we are still very angry. I couldn't believee it when I saw them advertise on t.v. Hopefully last nights programme will stop them in their tracks. We haven't discussed this with anyone else before, as we felt such complete fools at being duped !!!

We contacted several companies, and guess what ETOO found a corporate buyer and asked for a deposit of around £900. Thankfully he paid on a credit card and we got the money back - not quickly, but it did return to its rightful owner.

[Personal details removed by Moderator]from Reading had already been conned into paying monies up front for the sale of their timeshares to ETOO and another company called Greystones. Fees totalling 1400 Euros have been paid and no sales have ever happend. They were informed that there was a buyer at the desk waiting to purchase and all they had to do was pay the 800Euros up front for the sale to be done. Nothing further was ever heard. I visited the maidenhead office of CCC just last weekend with a family member who had received a call saying they were interested in buying her timeshare held in Malta and to take the deeds along with her. At the very start of the meeting, CCC told us that they had served a writ to ETOO and were having nothing more to do with them and they getting involved with them was the biggest mistake they had made. We were shown the Ebay site to demonstrate the low prices people were selling their timeshares for. We were then given a valualation for each of the timeshares we held and told they could take them off our hands and we would have no further maintenance fees to pay forever. To do this we just needed to pay a sum of almost £7,000 to CCC and we would get that fee back along with the valuation figues in 3 years time in a cashback scheme. They are obviously just another part of ETOO who are out to get people's money and then pay nothing out at all at the end of any period of time. This should not be allowed to continue to happen.

We contacted ETOO and were sent all the paperwork to sign and also asked for a fee of 1195euros. It all seemed to be genuine so we paid the fee using a credit card. The paperwork states that ETOO are members of " The International Timeshare Resale Association" and the code of ethics obligates ETOO to provide a safe and professional service to its clients and this ensures they adhere to all the legal requirments. The address to return the paper work to was in London but they also had offices in Spain. As a timeshare resale company we did not find this unusual but now realise we should have done. The paperwork they gave us stated that they could get £15448 for our timeshare. This was a good price as it was roughly what we has paid for it. ETOO contacted me on Tuesday 18 November to say they had a buyer for our timeshare but I hade to go to spain to meet them. They said all Hotel bills would be met by them and all we had to find was they flight. I said no as they whole point was We wanted to release the money tied up in the timeshare not throw more money into it. They haven'y been in touch since despite leaving emails and messages. I now realise we have been duped after reading Watchdogs comments and wish I had never heard of ETOO. My only hope is that I can contact my Credit Card company and hopefully make a claim via them as I am not getting the service I paid for.No where on the paper work does it state how long my agreement is with ETOO it just says that it remains active until a satisfactory conclusion is reached. Obviously I have now contacted ETOO to say I no longer want their services. I'll wait and see if they reply!!!

Addressing the various points you make:

    1. Not all timeshares run for perpetuity.

    2. If you stop paying your maintenance fees, it is more than likely that you will never hear back from your timeshare company and they will simply repossess it.

    3. I would be interested to be shown proof of one example of a timeshare resort pursuing the children of a deceased timeshare owner for non payment of maintenance fees, particularly if they never use it.

    4. Timeshare fees do not rise by as much as an average of 10 per cent per year.

    5. Some people have paid Club Class Concierge over ten thousand pounds and handed over the deeds to their timeshare in return for the dubious pleasure of membership of the Club Class Concierge product, when their maintenance fees have only been a few hundred pounds per year, so they have paid far, far in excess of six times their annual maintenance fees.

    2. that the ETOO sales people operate out of an unmarked office (I wonder why) on the same street as these shared admin offices, only some 20 metres away

    3. that CCC and ETOO share a cafeteria together in the building that houses these admin offices and when clients that have been sent to CCC in Spain by ETOO arrive at the offices, they are taken into the cafeteria for a drink so that the CCC sales people can try and establish some rapport with the clients and make a friend of them, in classic timeshare sales fashion. Then the CCC sales people have to let the clients know that they will not in fact be receiving any payment for the timeshare that they are selling. The clients quite often get very angry, as would be exected. What the clients do not know, as they start talk about how ETOO have deceived them into making a trip out to Spain o meet a buyer, is that the ETOO sales people quite often are using that same cafeteria at that very same moment.

    Commenting on ETOOs statement that:

'if after a period of time we find that they have not achieved a private sale we then contact these clients to ask whether they would consider alternative options' :

ETOO are supposed to try and market a timeshare for a 12 month period. I think you will find, even from reading the comments on this board, that ETOO almost immediately refer the clients to CCC without ever trying to find a buyer.

    Commenting on ETOOs statement that:

"During this invitation call, clients are never told that they will receive a cash offer"

This is simply untrue and can be borne out by a large number of people who have been told they will be paid a cash sum.

    Commenting on ETOOs statement that:

'It is a strategic decision not to mention the name of the company interested in meeting the client'

Some clients ask ETOO a number of times before they fly out to Spain who it is that they are meeting but ETOO never tell them. I think you will find that the strategic reason for this is that if the clients were told in advance of the meeting that the buyer that they were due to meet was Club Class Concierge, that the clients would look up CCC on the internet, see all the bad publicity about them, and then cancel the meeting, realising that they were not going to be meetimg somebody who wanted to buy their timeshare off them.

I am amazed that such an ownership does not attract an annual fee of £800 which totals £7500 over 7 years @ 10%. If not, I am very unlucky with my ownership company.

However, I recorded most of the conversation and the CCC rep denied there was any connection between them and ETOO.

On the advice of the Timeshare Consumers Organisation we have written to our credit card company and they have, to date, offered us half the money back we paid to ETOO. We are about to go back to them and say that is not acceptable.

We just wanted to know that we wouldnt have any more expense to fork out and reluctanly gave in.We have a contract here that states our 4868 points would be worth £5340.00 including the marketing agreement fees we paid of(595euros) up-front.Even the Hotel that was assigned to us cheated us out of a mealWe paid for it in cash and they charged us again thro' my bank. Have complained but no luck so far. Also paid 70 euros for transfer fees and they never turned up to take us back to the airport, we had to get a taxi.We have been lied to from start to finish and we do hope that these people will brought to justice for exploiting pensioners and any other vulnerable people.

Having watched your recent item about the European Timeshare Offer Organisation(Etoo), I wish to advise you that we have also paid Etoo 1200 euros to sell our timeshare points as my wife can no longer manage long distance travel because of health reasons. I have emailed Etoo six times, spoken to a staff member , Josh (?Gibraltar) who undertook to give us information about the venue of a meeting this Sunday, November, 30th in Edinburgh, and left two voicemail messages but without any response. [Personal details removed by Moderator]but all that happens is switchover to voicemail and, having left a message, there is no call back. I thought you might wish to add this complaint to your file on Etoo and would ask if there is a 'pressure group' of Etoo customers who are trying to take combined action for redress. Many Thanks.

My experience of ETOO has been very similar. The got in touch with me via my father. The initial phone call had them discussing with me their T&C's etc and that they would market my timeshare at a cost of £900, for that they would advertise my timeshare in the newspapers, tv and magazines. After a week or so I received another phone call from ETOO telling me they had a corporate buyer but I would need to travel to Malaga to finish the deal. I had to pay for the flight and they would put me up in a hotel overnight free of charge. I had asked for transport from the airport to the hotel. However when I arrived in the early hours of the morning there was no-one there to meet me, so I waited for an hour and then spoke to a girl who said all I could do would be to get a taxi and claim my money back the next day. I was very scared being in a strange airport on my own and not knowing what to do! The next day I was taken with 4 other people to Club Class Concierge. I was told that my timeshare was worthless and that I should cut my losses and take up their offer which was going to cost me £6K. I paid them a deposit of £2K and then came home. I cancelled my contract with Club Class Concierge and thankfully they returned all my paperwork. I don't know exactly what ETOO did with my £900 and I don't know if I can get it back? Can the Watchdog crew help me with this please?

Was called many times by ETOO, even after telling them i'm not interested the only way to make them vanish was to tell them my timeshare was sold, this worked well, never got another call.

I will never fork out money on "advertising" for timeshares. However i have been caught on the "turn up to a corporate" buyer from another company exactly the same, cast me £70 in fuel. I was extremly angry at the time. Its still happening now, can someone tell me HOW TO SELL MY TIME SHARE IN LAS VEGAS?????

    GOOD NEWS.
I got a full refund back through my credit card. this only after 3 months of phone calls, emails, registered letters being sent out from me to - i can barely bring myself to type their name - etoo... speaking to the bank which holds my credit crd and plenty of methodical patience. I did not sign the contracts which maybe the difference between getting your money back and not. I heard of etoo through TV advertising this past summer and felt like nearly everyone that it must be ok if it's on the tv!

We too fell for the Etoo advert and after e-mailing them were contacted by phone. Etoo advised us that our timeshare was worth a lot more money than we were asking for it and they should have no trouble selling it for us. They then asked us to pay them 1.195 euros there and then by credit card which we were told was for marketing purposes and this would be returned to us once our timeshare was sold.

Like everyone else we were eventually contacted and asked to go to Spain to meet a buyer for our timeshare. This we refused to do. We were then contacted again and asked to go to Maidenhead to discuss our sale. I asked who we would be meeting and was told this was one of their big corporate customers who they did a lot of business with. Yes you've guessed it, it was Club Class Concierge.

After an initial introduction to their salesman we were asked what we were expecting and what etoo had told us. We responded that etoo had asked us to attend the meeting to discuss the sale of our timeshare. CCC's response was that they were fed up with etoo and were thinking of not doing anymore business with them as they were constantly giving people incorrect information. They then went through their proposal about taking our timeshare off our hands and that we would receive an Euro CashBack Certificate which once returned to them in 3 years time, would ensure we received the value of our timeshare. We foolishly like so many others parted with our money to the tune of nearly £8,000 and to date have only received a CCC membership pack. Needless to say no CashBack Certificate has been received and all my e-mails to CCC regarding this have not been replied to.

I then decided I had been stupid enough and contacted the company we have our timeshare with. They advised us that CCC nor anyone else had made contact with them and as far as they were concerned the timeshare was still our responsibility and the maintence fee invoice would be sent to us for payment as usual. I realise we have been well and truly taken in. As the saying goes "If it seems too good to be true, it is too good to be true". I am going to speak to Trading Standards regarding CCC's accountant's involvement in this issue as all the cheques we wrote had to be made payable to them.

My credit card company is also investigating etoo on our behalf. Whether or not we can re-coup any of our losses remains to be seen.

We both also were dupped into giving ETOO a fee to sell our timeshares. They arranged for us to atend a meeting in the UK with Club Class Holdings. They bought the timeshares from us and we were told that we would receive 100% of the money via cashback europe in three years. We also had to buy membership to club class holdings. Thankfully the timeshare deeds are still held by the hotel and they have not been sent to Spain. The maintenance has also not been paid by club Class so technically they do not own the timeshares. The bad news is that we paid club class approx £5k for membership. Please can I have advise as to how I get this money back.

We missed this program because we were away on holiday. On our return we had a message on our answer machine from Roger Taylor of the legal department of [Personal details removed by Moderator]asking us to get in touch. Having got in touch he told us that ETOO had been rubbished publicly on the program and that his colleague, Mr Wright, of [personal details removed by moderator] Madrid had authorised him to refund me the money that I had paid to ETOO along with the money he got for selling my timeshare. He said that the money I had paid ETOO would be recoverd in court along with that of others. This all sounded very attractive but he also wanted me to put up 1200 euros for the deal to go forward. I declined this invition; if a deal sounds too good, it probably is!
Incidenty, I had the same treatment as others; being sent to the Costa del Sol to meet this "corporate client". I told them that I was not interested in their holiday club, they replied that my timeshare was worthless and that they were my only chance of offloading it. They also said that they were fed up with ETOO sending them their clients. I guessed that the two organisations were working together because ETOO organised the meeting and paid for our acommodation in a local hotel. I shall be pressing my credit card company for a refund.

To update you on our previous comment of 21st Nov (no.81) We have now recieved a refund from Etoo. After contacting Watchdog I sent a copy of the report and all of the complaints to our bank asking them to reconsider.
Within two weeks we had recieved two letters, one from the bank and one from Trading Standards, who I had written to previously, both saying that our correspondence had been passed on for further investigation. Last week I recieved a telephone call from Etoo telling me that the money was to be refunded. We have today recieved a confirmation letter and on checking my credit card account can confirm that the money was refunded to my card on 5th Dec. So don't give up. If enough of us resist this company's practices maybe they will realise that unfair trading will not work

We too were taken in by Etoo. The sales agent I spoke to told us that ours WOULD be sold. We were told that they had a major marketing event at the end of August which is why we needed to complete the paperwork quickly.

We received a call asking us to visit Spain told them we couldn't so they called back and offered Maidenhead and guess where we ended up!!

Like many others have said CCC told us they had cancelled their contract with Etoo and only seeing us as they wanted to honour pre-booked appointments this was at the beginning of October and sounds like they are still saying that now. They wanted £6000 for us to join which we didn't pay thankfully.

CCC told us that the TV adverts had been withdrawn and that Etoo had lied to us!!
