BT and the iPlayer 7:24pm on 10 Jun 2009 or is it the fact the most of the content on BT vision is available on iplayer without having another box and contract from BT?

and so BT are not seeing the expected demand for BTVision?

also i thought last time this came round BT, MV etc agreed that the BBC had a (peering arrangement) link direct into their networks, so reducing the load on their internet gateways?

as to people downloading excessive amounts perhaps ALL the isp's should abandon this "unlimited" broadband package that is in fact limited by a "fair usage policy", and stop bundling services at lower and lower cost (and lower profit or even loss) and return to a sensible pricing structure

the other thing BT should can is the use of DPI kit (like webwise / phorm / webwise discover) to snoop in customers to provide targeted advert and make income to try and cover some of the losses they are making

no mention of the requirement to get permission of the websites visited for use of content for commercial gain
no real mention the user has to agree to the webwise advertising system or how the monitoring works, so much for informed consent
as to the survey, 81% of people who showed a preference, so how many people showed a preference? if only 10% showed a preference that then changes to only 8.1% of the total number of people, without the full data quoting percentages is meaningless

let me as you these simple questions (lets see if you can provide detailed reasons and answers to the questions below)

1:- "as the BBC can't make any revenue from advertising as they are financed by the license fee, what benefit is there in allowing phorm to scrape their website as they can't participate in phorms OIX advertising platform which uses the targeting data generated by the webwise system?"

2:- "would allowing phorm to scrape the bbc websites leave them open to any legal action by third parties who allow the BBC to publish their content so long as it is not used for commercial gain? (bearing in mind phorm and their ISP partners would be making a commercial gain from selling the ability to target avertising based on the content on the BBC pages phormed ISP customers viewed)

i have a job, i am a technical consultant for a relativley large company, with a background in networks and security, i have read a lot of information about phorm and the systems it provides to ISP's

i have done my research via phorms websites, the PIA, clayton, fipr etc

phorm claim they have legal advice to show their product is legal, so why not publish it to prove it? or are phorm worried the advice is not water tight and would expose them to more bad press or possibly other action? is it the same as the claimed support of the Home Office or BERR, both of who have publically denied endorsing phorm or it's technology

all of this information and questions and pointoforder you still expect the BBC to say "yes to phorm , come scrape our pages against our charter, we do not mind"

you don't need to be einstein to see the issues and say NO to phorms technology

As for 'Phorm offer nothing of value' that is demonstrably untrue. Many people would prefer to receive relevant rather than irrelevant advertising. Many people would prefer to spend valuable advertising budgets wisely. Many people would like to make some money from their website, without having to rely on Google's search rankings and volume-based traffic alone.

there we have the issue, people may wish advertising to be more relevant, BUT phorm and the ISP partners like BT should not gather targeting information from websites without the websites permission.

in the BBC's case it is against the BBC charter to allow third parties to use content for profit as there are funded by the license fee and not by advertising revenue, and as stated before they do not have permission from third parties to give permission for content to be scraped by the phorm / webwise / qooksmartweb DPI kit supplied to the ISP Partners

and as to copyright etc, websites nearly all have copyright statements and terms of use policies (even the BBC) many of which prohibit use of content for commercial gain, if the website has clear policies on the front page and copyright notices on every page why should they notify phorm, Privacy in Electronic Communications Regulation (PERC) clearly states services such as phorm should gain permission from both sides of the communication (that means opt-in NOT opt-out), the ownous is on phorm or the isp partner to get the permission of both sides not just one

and the homeoffice advise note does not say phorm is legal it says "phorm could be operated in a legal manner" but it does not go on to qualify how

WHICH IS WHY THE BBC SHOULD OPTOUT NOW!!!

is this also why phorm are appear to be going to launch a desktop widget on 3rd june (see korean phorm site for details) are they having issues with DPI / interception based methods of data collection?

that should speak volumes for readers of this blog

this has also been a pattern i have seen on other forums and blogs, along with thread diversionary tactics where phorm and or their associated PR compaines etc post

so lets keep it on topic, THE BBC and PHORM / WEBWISE OPT-OUT and COMPATIBILTY WITH THE BBC CHARTER

thankyou for confirming you are a phorm employee or a phorm PR person

phorm had to withdraw that claimed link between the nick of dephormation and bluecar from its stopptoulplay website as it is totally incorrect, it was actually in one of the first batches of changes to phorms "truth about smears"

let me confirm for the record, i am not the user you have claimed i am, nor never have used the nick dephormation on this or any other forum

now if you will stop the diversionary tactics and attempts at smears lets get back on topic, which is about the BBC and whether phorm / smartweb / qooksmartweb / webwise is against the bbc charter and whether the BBC should opt-out all of their domain names from profiling and the potential issues of copyright claims by allowing there content and third party content licensed to them for non commercial gain

as i said before

that way the BBC has procected their customers data until the the position over phorm is clear, but at the same time have kept their options open

the only issue with the above is phorm need to provide a way for websites to verify that phorm is acting as requested and not processing pages from websites who have opted out!!

only problem is due to DPI being a stealth type technology that is difficult as the system is designed to be invisble, and if you read the BT pagesense trials paper on wikileaks you will see the sucess was measure by BT customer not being able to detect the system was in use

ball is firmly in phorm's court on that one
