BBC HD: Wimbledon and some Top Gear questions 1:23pm on 03 Jul 2009 I believe that Top Gear is one of the BBC's most beautiful programmes, with care taken to frame and filter shots to show the cars to their best. Putting that on the BBC HD channel, along with hearing the cars in Dolby Digital sound would be a comparable showcase of HD to colour television's broadcast of snooker.
Conflict over copyright 4:40pm on 26 Nov 2008 Rory, it's a no-brainer that the situation is out of order and unacceptable. I don't know of a single patent attorney (forming the inventor's work into the patent document), book editor (forming the author's work into a publishable format) or actor (performing the playwrite's work on stage) who is paid after their work is done. Of these, the patent attorney holds copyright in entirety for the words he or she wrote; the book editor added contributions to shape the text while the author was writing it and so might be considered co-owner of the copyright; the actor holds no rights in their performance after the show is done. So why are musicians afforded rights in their performances when actors aren't?

It's grossly unfair that performing musicians get paid after their work is done. And to extend this unfair protection because a performer failed to protect their income when it was available to them only rewards this irresponsibility. It is sad when people are old and poor and can't support themselves financially. But it's less sad when they were once famous and now are not, having not held on to their riches.
BBC licence free: name that figure 12:01pm on 26 Nov 2008 I'd pay a small national licence fee to maintain the broadcast network and BBC News service: £30 per year.

Then I'd pay to subscribe to broadcast channels individually, with unlimited internet access to old material broadcast on those channels. Pick a number: £2-£5 per month per channel.

Also make the BBC content available on iPlayer with a subscription for a certain number of minutes viewed per month, or a pay-per-view system, or a combination (where the subscription discounts the pay-per-view items).

I'd also be willing to pay a top-tier price for unlimited access to a DRM-free media archive -- I'd accept a 50% premium to be able to do what I like with the media. but how would you sell that to the program producers? Have it watermarked with my account details at point of delivery so that you can identify it to me if it ends up on a file-sharing site, and have the terms of use make me accept liability for the infringement.

Please consider any new model, but don't let the great news service of the BBC or the great original programming be swamped by having to pander to market forces. Because of the unique way it's funded: Poldark on Mopeds.

No defence for 'stealing' music 1:19pm on 03 Jul 2008 Stealing still isn't the right word. Taking the car and abandoning it relieves its owner of the capability of using the car while you have it. When I copy digital data, I'm not stopping anyone else from accessing that data. There is no trespass to property (another legal term) because the property remains with the place it was legally supplied.

Also, what music do you have on your computer? I am concerned that my own CD's, stored on my computer for private/research/backup use might be copyright infringement. The CD's say 'no unauthorised copying' on them, so I have to use the exceptions in the law to defend the copies on my computer.

Finally, DRM: please consider adding that DRM is conceptually flawed: the protection has to be supplied with the way to overcome the protection, or law-abiding users won't be able to enjoy their purchases. This leaves a big hole through which the buying public is able to restore their fair-use or fair-dealing rights previously obscured by DRM. Until the movie or music or games companies control the boxes through which we use their works of art*, there will remain this hole.

*NB: the XBox Live, Playstation Network and Nintendo Wii online all provide updates which can restrict the use of these devices in the hands of the end-user; but are still futile because the hardware is sold to the user to do with as he or she pleases -- even tinkering and soldering.
